The Department of Labor’s (DOL) Employee Benefits Security Administration (EBSA) has issued a new model Employer CHIP Notice with information current as of July 31, 2025.
Employers with group health plans in states offering Medicaid or CHIP premium assistance must provide an annual CHIPRA notice. Employers can provide this notice either separately or with health plan eligibility materials, open enrollment documents, or the summary plan description.
Covered Employees
Employers must provide this annual notice if their group health plan covers participants living in a state with premium assistance, regardless of the employer’s location.
The DOL’s model Employer CHIP Notice, updated as of July 31, 2025, is updated periodically to reflect changes in the states that offer premium assistance. Employers may use, modify, or create their own notice, but must include state contact details for employees in states offering premium assistance. Download the bulletin for more details.
