Model CHIP Notice Updated

The U.S. Department of Labor's Employee Benefits Security Administration (EBSA) has issued a new model Employer CHIP Notice as of March 17, 2025.

 

Background

Employers must annually notify employees about premium assistance under the Children’s Health Insurance Program Reauthorization Act of 2009 (CHIPRA) if they offer group health plans in states with Medicaid or CHIP subsidies. This notice can be provided alone or with health plan eligibility materials, open season/election materials, or the summary plan description (SPD).

 

Covered Employers

Employers must provide this annual notice if their health plan covers participants in states offering premium assistance subsidies, regardless of the employer's location.

The DOL’s model Employer CHIP Notice, updated with information as of March 17, 2025, reflects changes in states offering premium assistance subsidies.

Employers can create or adjust notices, ensuring they include essential state contact details for employees in states with premium assistance.
