This notice can be provided alone or with health plan eligibility materials, open season/election materials, or the summary plan description (SPD).   ## **Covered Employers** Employers must provide this annual notice if their health plan covers participants in states offering premium assistance subsidies, regardless of the employer's location. The DOL’s model Employer CHIP Notice, updated with information as of March 17, 2025, reflects changes in states offering premium assistance subsidies. Employers can create or adjust notices, ensuring they include essential state contact details for employees in states with premium assistance.   ## **Employer Resources** The EBSA’s CHIPRA webpage offers the latest model notice, fact sheet, compliance guide, and more for employers and advisers, available in English and Spanish.
