The Department of Health and Human Services (HHS), Labor, and the Treasury Departments issued an FAQ about the enforcement of the contraceptive coverage mandate under the Affordable Care Act (ACA).
In November of 2018, the Departments published final regulations which expanded the exemptions and accommodations to the contraceptive mandate to apply to any entities with moral/religious objections to the coverage requirement. Recent litigation in July of 2020 upheld these regulations.
The new FAQ indicates that the Departments intend to issue regulations within six months to amend the 2018 final regulations. The FAQ doesn’t provide any indication of what changes may be made.
