The Republican party has indicated that they will no longer attempt to repeal and replace the Affordable Care Act (ACA). They lost control of the U.S. House of Representatives to the Democrats during November’s midterm elections and it is unlikely they would receive any bipartisan support to any proposed changes. Many Democratic candidates had campaigned on health care issues, such as protections for those with pre-existing conditions.
For now, the Affordable Care Act will remain current law and employers should continue to follow its rules and regulations accordingly. However, employers should continue to monitor ACA developments, as the Trump administration may continue to change how the ACA is implemented.
