The recently approved Consolidated Appropriations Act, 2023 (CAA 2023) includes a new 2-year extension of the telehealth waiver. Temporary relief had been provided to high deductible health plans to provide telehealth at low or no cost prior to meeting an individual’s deductible to keep their HSA eligibility. This relief was slated to expire December 31, 2022, but has been extended to December 31, 2024. This will apply to plan years beginning after December 31, 2022, and before January 1, 2025.
This relief is still only temporary, and employers may need to review their plans to see if changes need to be made closer to 2025. Hopefully more permanent guidance will be released prior to the new deadline. For questions, please contact your NIS Employee Benefit Consultant.
