Two new federal laws have extended employment protections to employees affected by pregnancy, childbirth, and related conditions.
The Providing Urgent Maternal Protections (PUMP) for Nursing Mothers Act expands the Fair Labor Standards Act (FLSA) to require employers to provide employees with breaks and privacy for expressing breast milk. This law is effective April 27, 2023.
The Pregnant Workers Fairness Act (PWFA) extends the Americans with Disabilities Act (ADA) to provide reasonable accommodations to employees affected by pregnancy, childbirth, and related conditions. This goes into effect on June 27, 2023.
Employers who violate the new laws are subject to pay punitive damages, actual damages, costs, and penalties. Guidance on the new accommodation requirements will be issued by the Equal Employment Opportunity by June 2024. Employers should become familiar with the new laws in the meantime.
