New Model Employer CHIP Notice Released

The Department of Labor released a new model Employer CHIP Notice with information current as of July 31, 2024.

 

Background

The Children’s Health Insurance Program Reauthorization Act of 2009 (CHIPRA) mandates an annual notice for employers with group health plans in states offering premium assistance subsidies through Medicaid or CHIP. Employers have the option to share this notice independently or alongside:

  • Communications about health plan eligibility
  • Materials related to open enrollment
  • The summary plan description (SPD)

 

Covered Employees

Employers must comply with the annual notice requirement if their group health plan covers individuals residing in a state offering premium assistance, regardless of the employer's location. The Department of Labor's model notice, available for employer use, is regularly updated to reflect states with premium assistance programs. Employers have the option to customize their own notices or modify the model notice, ensuring to include relevant state contact information for employees in states with premium assistance.
