President Trump recently signed the Families First Coronavirus Response Act (the Act) into law. The Act requires employers to provide paid leave for some employees related to the COVID-19 pandemic with some other provisions.

The Act’s key provisions are:

Emergency Paid Sick Leave

  • Eighty hours of paid sick leave for government workers and employees who work at a company with fewer than 500. Leave is available to workers who are sick, have to care for children, or have a sick family member.

Emergency Family and Medical Leave Act (FMLA)

  • Provides FMLA rights for some employees working for a company with less than 500 employees, requiring partially paid leave after 10 days when an employee is unable to work or telework due to school or childcare closures due to the coronavirus.

Additional Provisions

  • Economic assistance funding
  • Health plans are required to cover COVID-19 testing at no charge
  • Employers who provide paid sick leave benefits required by the Act are eligible for a refundable tax credit

Emergency leave benefits for workers (that are provided under the Act) would expire on December 31, 2020. For more information, download the bulletin.
