The U.S. Department of Labor (DOL), through its Employee Benefits Security Administration (EBSA) released a new model Employer CHIP Notice.
Under the Children’s Health Insurance Program Reauthorization Act of 2009 (CHIPRA), employers with group health plans in states providing premium assistance subsidies must provide an annual notice. This notice can be provided separately or alongside materials on health plan eligibility, open season/election process materials, or the summary plan description (SPD).
An employer must provide an annual notice if their group health plan covers participants residing in a state with a premium assistance subsidy. The DOL’s model notice is regularly updated to reflect changes in states offering premium assistance subsidies, including information current as of January 31, 2024. Employers can use the model notice or create their own, but they must include relevant state contact information for employees in states with premium assistance.
