EEOC Issues New “Know Your Rights” Poster & Fact Sheet

The Equal Employment Opportunity Commission (EEOC) has issued a new poster called “Know Your Rights”. This will update and replace the previous “EEO is the Law” poster.

Poster Updates

The new poster aims to make it easier for employers to understand their legal responsibilities and for employees to understand their legal rights. Updates include:

  • More straightforward language and formatting;
  • Notes that harassment is a prohibited form of discrimination;
  • Clarifies that sex discrimination includes discrimination based on pregnancy and related conditions, sexual orientation, or gender identity;
  • Provides information about equal pay laws for federal contractors;
  • Adds a QR code for applicants or employees to link directly to instructions on how to file a charge of workplace discrimination with the EEOC.

Employers with 15 or more employees must prominently display this poster at their worksite location. They are also encouraged to post the notice on their organization’s website. In most cases, an electronic posting should be in addition to a physical posting. Electronic only postings are acceptable if there is no physical workplace, if employees work from home, and in similar situations. There is no specific deadline to replace the old poster, but employers should do so within a reasonable amount of time. The EEOC has also issued a fact sheet containing FAQs about the poster.
