Joint Statement Released Regarding AI and Automated Systems

Four federal agencies have issued a joint statement regarding artificial intelligence (AI) and automated systems. Automated system is a broad term meaning software and algorithmic processes (including AI) that are used to automate workflows and help people make decisions or complete tasks.

The statement declares that existing laws and regulations which address discrimination will also apply to the use of automated systems and innovative new technologies. The use of these systems may perpetuate unlawful bias, automate unlawful discrimination, and produce other harmful outcomes. The agencies pledge to protect individuals’ right regardless of whether legal violations occur through traditional means or advanced technologies.

The joint statement doesn’t create or change any rights or obligations for employers. But employers who use automated systems to make employment decisions, should familiarize themselves with the joint statement and ensure that their policies and practices comply with all applicable laws.
